Married Women's Separate Property, 1859-1902

Article XV, Section 5 of the Oregon State Constitution provides that "The property and pecuniary rights of every married woman, at the time of marriage or afterwards, acquired by gift, devise, or inheritance shall not be subject to the debts, or contracts of the husband; and laws shall be passed providing for the registration of the wife’s separate property."
 

Few Jackson County women take advantage of the additional layer of protection that actual registration offers; below is a transcription of the entire register, preserved in the offices of the Jackson County Clerk.


Declaration of Mrs. Ann Rogers to hold separate property
I hereby declare that it is my firm and full intention to hold in my own right, separate and apart from my husband or any other person, the following described property, to wit: Three promissory Notes bearing date June 1st A.D. 1859, calling for the payment of Five hundred dollars each, due in twelve months from date or sooner if certain moneys are disbursed by the Indian Superintendency. Also one note calling for the payment of Three hundred and twenty five dollars and in all other respects like the above described notes--All the above notes [are] signed and payable by Patrick Flanagan and were given to me in payment for my donation claim of land. The above described property and proceeds thereof it is my full and firm intention to hold in my own right and convert to my own use.
    In testimony whereof I have hereunto set my hand and seal this the (13th) thirteenth day of July A.D. 1859.

Declaration of Mrs. Jeanne Logier to hold separate property
Know all men by these presents that I Jeanne Logier [sic--Jeanne Langier] of the Town of Jacksonville, County of Jackson and State of Oregon do hereby declare my intention to hold in my own right separate and apart from my husband or any other person whomsoever and for my separate use and benefit, the following described property, to wit: Parts of Lots numbered one (1) and Two (2) in Block No. Twenty seven (27) in the Town of Jacksonville, Jackson County and State of Oregon, said Lots situated on the South east corner of Oregon and Main Streets fronting Thirty feet on said Oregon Street and running back seventy six feet on Main Street, being the same property conveyed to me by John Anderson & wife by Deed bearing date the twelfth day of July A.D. 1859 and recorded in the Recorder's Office of Jackson County Oregon in Record Volume 2 Page 349. And I hereby declare it to be my full intention to hold the above described property as my separate property under the Act of the Legislative Assembly of Oregon, approved June 4th 1859. Also all the furniture & personal property in the house on said Lots.
    In testimony whereof I have hereunto set my hand and seal this 31st day of August A.D. 1859.

Declaration of Mrs. Celeste True to hold separate Property
Know all men by these presents that I Celeste True of the County of Jackson and State of Oregon do hereby declare my intention to hold in my own right, separate and apart from my husband or any other person whomsoever and for my separate use and benefit the following described property, to wit: Two gray Mares, Six Oxen branded C.T. Three Cows, same brand, three calves same brand and marked crop off right ear and half under crop same ear. Nine Hogs same mark, and one Wagon, and I hereby declare it to be my full intention to hold the above described property as my separate property, under the act of the Legislative assembly of Oregon, approved June 4th 1859.

Declaration of Mrs. Eliza Ann Hoxie to hold separate property
Know all men by these presents that I Eliza Ann Hoxie of the County of Jackson and State of Oregon, do hereby declare my intention to hold in my own right, separate and apart from my husband or any other person whomsoever, and for my separate use and benefit, the following described real estate, to wit:
    The East half of a half section tract of public land, known and designated in the Surveys and plats of the United States as the Claim No. 54 in Township 38S. of Range 1 West, Willamette Meridian, more particularly described in the donation Certificate No. 483 granting to Obadiah D. Hoxie a half section of Public land and the east half is designated to his wife Eliza Ann, granted on the 18th day of June A.D. 1858 at the Land Office for Umpqua District, at Winchester, Oregon Territory, and I hereby declare it to be my full intention to hold the above described Real Estate with all the appurtenances thereto belonging, under the Act of the Legislative Assembly of Oregon approved June 4th A.D. 1859.

Declaration of Mrs. Fannie D. O'Meara
Be it known that I, Fannie D. O'Meara, a married woman, the wife of James O'Meara, of Jacksonville, Jackson County, Oregon, hereby declare it to be my intention to hold as my separate property, a certain pianoforte given to me by my Father James Davidson.

Declaration of Mrs. Emily T. Allen
To all whom it may concern, Be it known that I Emily Theresa Allen, of the Town of Kerbyville in the County of Josephine and State of Oregon have this 21st day of February 1861 caused to be registered as my separate property, situated in the Town of Jacksonville, County of Jackson State of Oregon, consisting of One third of a house and Lot on California Street in said Town between the Lots of W. G. T'Vault and Pat. Ryan and known as the Estate of Charles Casey, which property I hold in my own right, separate and apart from my husband, to deal and traffic with as a feme sole and I do hereby declare my intention to hold the same and to claim all the pecuniary rights connected therewith that the law allows.

Mary Meddagh
Declaration of Mary Meddagh to hold separate Property
Know all men by these presents that I Mary Meddagh of the County of Jackson and State of Oregon do hereby declare my intention to hold in my own right, separate and apart from my husband or any other person whatsoever, and for my separate use and benefit, the following described property, to wit:
    2 bay Mares, and their colts, 2 years old, one of said Mares branded H on the left shoulder and the other branded F (upside down) on the left hip.
    1 Yellow horse 8 years old bought by me from T. S. Moon.
    11 head of Cows and yearlings marked with 2 slits in the right ear and one slit in the left ear.
    35 Head of Hogs with the same ear marks and
    1 Two horse wagon
and I do further declare that it is my intention to hold the above described property as my separate property under the provisions of the Act of the Legislature Approved June 4th 1859.

Deed and Declaration to hold separate property

    Personally appeared before me the undersigned a Justice of the peace in and for the County of Jackson, Helen Bledsoe of the State of Oregon and County of Jackson, who made declaration that the foregoing property was hers in own right, by Deed of Gift, separate and apart from her husband and agreeable to an Act passed June 3rd 1859, entitled an Act to provide for the Registration of separate property of Married women and to declare the effect thereof, to wit: One hundred and sixty 81/100 Acres of land, per deed of gift made on the 29th day of January A.D. 1861 by James Kinney and his wife Mary Kinney to their daughter Helen Bledsoe, Also to Six Cows and Calves and One Mare and Colt.

Declaration of Catharine O. Henderson to hold separate Property
    Know all men by these presents, that Catharine O. Henderson of Jackson County, Oregon, wife of Stephen J. Henderson of the same place do assert and declare that I am the owner in my own right of both real and personal property and estate in said Jackson County and State of Oregon which I hold and claim, possess and occupy as my individual and separate estate and interest and in no way subject to the control or disposal of my said husband or for or on his account, which said property is described as follows to wit: The East half of the half section of land claimed and now occupied by the said Stephen J. Henderson and the above claimant under and by virtue of the laws of the United States of America granting and donating Public Lands to actual settlers in the State of Oregon, being the same premises upon which the claimant is now residing in Jackson County State of Oregon and by this claimant supposed to be the East half of the South half of Section Eight (8) in Township Thirty seven (37) South of Range number One (1) West, of Willamette Meridian of the State of Oregon, but the description by number is uncertain and now out of the actual recollection of claimant.
    Also the following described personal property Consisting of Cattle and horses on the range at or near the residence of this claimant or within Jackson County aforesaid, viz: of Cattle, Eighteen head of American Milch Cows at Mr. Stearns east of Jacksonville, with their calves a lot of Muleys or hornless cattle running in the band of said Stephen J. Henderson and being all of that description belonging to said band. The Cow known as the Lill Cow or bell Cow with all of her increase. Two Cows called the Richey Cattle and all of their increase, running near Gold Hill; One Cow known as the Lane Cow and her increase, including a heifer with broken horn all supposed to be ranging on Lane Creek. The Cattle known as the "Blackey Stock." The Sam Mace blackey & her increase being a spotted four year old Cow and calf & a white speckled three year old Cow and Calf--lined backed two year old heifer and their increase. One white faced brindle Cow and increase--a five year old Cow and their increase. One cow brockled one horn lower than the other. One red Cow the increase of the muley stock of Cattle some white on her back with her increase. One white speckled Cow known as "Pett" and her increase the oldest being a speckled young Cow with a calf; the increase of the Cows at Stearns. Two roan bulls being the blackey stock of Cattle. The Cow known as the Widow blue and her increase four in number; All Cattle known as the Hamlin Marked a Cross & slit in the right and an under slope in the left ear. The Cow known as the "Lize Cow" and her increase about eight in number; One cow called "broken horn" and her increase about six in number; Four Cows known as the white flag and their increase about nine in number. One red white faced cow called the Morgan Cow. The "Mahogany Cow" and her increase and the increase of the increase (two of them yellow with white faces) about eight in number. The "Rockfellow Cow" and her increase including a black cow and her increase and a black heifer & her increase and a four year old Steer. The Ryecraft Stock of Cattle; All of the above Cattle being branded in the brand of the said Stephen J. Henderson SH on the right hip, ear marks on some of various kinds some with crop off the right ear & hole in the left ear--and some of them marked with the mark of this claimant in addition, being a small slit in the cropped ear. Also of Horses, the following; A young bay mare had of Burns of Gasburg with her colt. One bald faced Indian Mare with ear marks with yearling Colt and a sucking Colt. One bay mare known as "Flora Milner" and her two Colts. That all of said before described estate & property is the result of my own estate by care, management & increase; except the donation of said parcel of land by the Government as before stated. That the said stock is ranging with the cattle & Stock of my said Husband and this declaration is made to protect me and my heirs in the same and the ownership, use, enjoyment, or disposal thereof in my own right as by law provided.

Declaration of Frances B. Willett
    Know all men by these presents that I Frances B. Willett wife of William Willett, make the following declaration in my individual and own right--First, That I have acquired by gift from my Father Asa Trammel the following described property, to wit: One span of Mare Mules color black, One Wagon, One set of Harness, One House at Willow Springs, known as the Willett Saloon; One House at Blackwell Diggings, One house, Stable and Corral at Big Bar Rogue River all in Jackson County, Oregon, Also One Mare & Colt, two yoke of Oxen, fifteen Cows, twenty two head of One and two year old Cattle, One Chest of Carpenter's tools, One saddle and Bridle, One Scythe, two pitch forks, four Log Chains, One half of a mining Claim in Blackwell Gold Diggings, known as the John McCoy claim. One half of the Claim known as the Dutch Henry claim, all situated in Blackwell Diggings Jackson County Oregon.
    I Frances B. Willett hereby declare and make known to all persons concerned that it is my intention to hold the above described property in my own right separate and apart from my said husband William Willett.

Declaration of Margaret Little
    Know all men by these presents that I Margaret Little wife of James B. Little, of the Town of Jacksonville Jackson County and State of Oregon, do hereby declare my intention to hold in my own right, separate and apart from my husband or any other person whomsoever, and for my separate use and benefit, the following described property, to wit: A Lot of ground adjoining the Town plat of the Town of Jacksonville Jackson County & State of Oregon, on the East side of said Town, fronting on California Street 172 feet, and running back on the West line of the Lot occupied by J. S. Drum 338 feet, thence N.W. 126 feet to Clugage's S. line, thence Northwardly 245 feet to beginning, being the same property conveyed to me by James Clugage by Deed bearing date the 11th day of October A.D. 1860 and recorded in the Record of Deeds Vol. 2 Page 554 in the Recorder's Office of Jackson County & State of Oregon. And I hereby declare it to be my full intention to hold the above described lot and premises as my separate property under the provisions of the Act of the Legislative Assembly approved June 4 1859.

Declaration of Jane McCully
    Know all men by these presents, that I, Jane McCully of the Town of Jacksonville, County of Jackson and State of Oregon do hereby declare my intention to hold in my own right, separate and apart from my husband J. W. McCully or any other person whomsoever, and for my separate use and benefit, the following property, to wit: Lots number Three (3) Four (4) Seven (7) and Eight (8) in Block No. 9 as laid down on the Recorded Plat of the Town of Jacksonville, Jackson County & State of Oregon, fronting 100 feet on California Street and running back the same width 200 feet, Together with the Tenements and improvements thereon, being the same lots conveyed to me by Deed executed by James Clugage and bearing date the 15th day of May A.D. 1861 and recorded in the Recorder's Office of said Jackson County in Record Vol. 3 Page 106. And I hereby declare it to be my full intention to hold the above described lots and premises as my separate property under the provisions of the Act of the Legislative Assembly Approved June 24 1859.

Declaration of Mrs. Mary Jones
    To All whom it may concern, Know ye that I Mary Jones wife of J. A. Z. Jones of the County of Jackson and State of Oregon having this day acquired in my own separate and sole right by Deed of Gift from Elijah Chaney, the one third interest in the following described mining claim and water privilege, to wit: the mining claim worked during the winter of 1860 & 1861 by J. A. Z. Jones, P. Gilfeather and William Sutherland, the same being one third of the undivided interest and water privilege owned jointly by P. Gilfeather J. A. Z. Jones and myself by said Deed of gift from Elijah Chaney, also One third interest in the Cabin occupied by P. Gilfeather; Also one half interest in the fluming privilege taken up and recorded by J. A. Z. Jones, situated in the Willow Springs Gold Diggings in Jackson County State of Oregon. Therefore in accordance with the provisions of an act of the Legislative Assembly of the State of Oregon approved June 4th 1859 to provide for the registration of Separate property of Married women and to declare the effect thereof, I, Mary Jones wife of J. A. Z. Jones of the County and State aforesaid hereby do declare it to be my intention to hold the mining claim, Cabin and water privilege herein before described as my separate and sole property together with the privileges, proceeds and all the benefits accruing from the same.

Declaration of Catharine Herling
    Be it known by all whom it may concern, that the undersigned a Married woman, do hereby declare my intention to hold the following described Real Estate as my separate property, to wit: Lot No. One (1) in Block No. (6) Six, Also Lot No. 2 in Block No. (6) Six lying and being situated in the Town of Jacksonville State of Oregon, together with all and singular, the hereditaments and appurtenances thereunto belonging or in anywise appertaining.

Declaration of Mrs. Mary E. Tillett [sic]
    Declaration of Mrs. Mary E. Tillette to hold separate Property.
    To all persons whom it may concern.
    Know ye that I Mary E. Tillette wife of Charles Edward Tillette make, declare and acknowledge this my declaration to hold in my separate right, separate and apart from my husband Charles Edward, the following described pieces or parcels of ground, to wit: The North half of lots No. 5 & 6 in Block No. 22, situated on Third Street in the Town of Jacksonville, Jackson County State of Oregon, together with the buildings, improvements and appurtenances thereunto belonging, the same having been acquired in my own name and right by purchase from Thomas Curry and the price and consideration paid for said lots and improvements at no time ever having come into the possession or under the control of my said husband.

    Know all men by these presents that I Mary E.     Know all men by these presents, that I Jane McCully of the County of Jackson and State of Oregon, do by these presents, declare my intention to hold in my own right, separate and apart from my husband J. W. McCully or any other person whomsoever, the sum of One hundred dollars in legal tender notes, which came to me from my Maternal Ancestor's Estate; I further declare that it is my intention to invest the said One hundred dollars in a certain tract of land, of which I claim to be the occupant, being a part of fractions of land entered by the Trustees of the Town of Jacksonville for the use and benefit of the occupants of such land, as a part of the Town site of said Town of Jacksonville, under the provisions of the Act of Congress relating to Town sites. Declaration of Mrs. Jane McCully to hold separate property
    Know all men by these presents, that I Jane McCully of the County of Jackson and State of Oregon, do by these presents declare my intention to hold in my own right, separate and apart from my husband J. W. McCully or any other person whomsoever, the following described real estate, being a certain tract of land of which I claim to be the occupant and conveyed to me by the Trustees of the Town of Jacksonville, Jackson County, State of Oregon, for the consideration of One hundred dollars in legal tender notes, which sum of One hundred dollars came to me from my maternal ancestor's estate; said real estate described as follows, to wit: Beginning at a point on the South line of Clugage's claim, 23.48 chains of the South East corner of said claim, and running thence West 10.30 chains on Clugage's South line to the East line of 3rd Street, thence S. 22°30´ W. 8.08 chains, thence South 67.30´, E 7.19 chains; thence S.
2°15´ E 6.50 chains, thence S. 35°45´ E. 2.50 chains; thence South 63° 0.60 chains to South line of the corporation of Jacksonville, thence East 11.04 chains on the Corporation line, thence N. 8°45´ W. 15.65 chains, thence N. 57°15´ West, 4.56 chains, thence N. 28° West 1.00 chains to the place of beginning, containing 26.29 acres, excepting and reserving from said tract of land, so much thereof as is occupied by the California Stage Company and designated on the corporation Plat of Jacksonville, as the north half of Block No. 32; and also excepting and reserving the Streets laid out by the Corporation on said tract of land.     Know all men by these presents, that I, Roxanna Thurber of the County of Jackson in the State of Oregon, do hereby make known and declare my intention, to hold in my own right separate and apart from my husband, John Thurber, Senr. or any other person whomsoever and for my separate use and benefit, the following described Real estate, lying and being in the County of Jackson, in the State of Oregon, to wit: The East half of the South East quarter of Section Nineteen (19) and the North West quarter of the South West quarter of Section twenty (20) all in Township No. Thirty Eight (38) South, of Range One (1) West, containing One hundred and twenty Acres.
    Also the following described personal property to wit: Two Cows and three yearlings Also certain money or draft due and coming to me from the estate of my Mother, who died in the State of Vermont, which money or draft has not been received at this date, but I claim the same as my separate property whenever the same shall come to hand; I also claim all the improvements and appurtenances now made or to be made on the above described land and also any and all personal property I may hereafter acquire.
    I do hereby declare it to be my intention to hold and enjoy all the above described real and personal property as my own separate property as aforesaid under the provisions of the Act of the Legislative Assembly of the State of Oregon, Approved June 24th 1859.

Declaration of Jeanne Guilfoyle to hold separate property
    Know all men by these presents, that I Jeanne Guilfoyle, a married woman, the wife of John Guilfoyle of the County of Jackson and State of Oregon, do hereby make known and declare my intention to hold in my own right, separate and apart from my said husband and by his consent and for my separate use and benefit, the following described real and personal property, and being in the Town of Jacksonville County of Jackson and State of Oregon, more particularly described as follows, to wit: All that tract or parcel of land situate at the S.E. corner of Oregon and Main Street in said Town, being parts of Lots Nos. one and two in Block No. 27 of the recorded plat of said Town, fronting 30 feet on Oregon Street aforesaid and running back the same width 76 feet on Main Street aforesaid;  Also a lot (a lot) or piece of ground beginning 76 feet from the North West corner of block No. 27 on Main Street, running thence South easterly with Main Street 72 feet and running back the same width from said Main Street 150 feet, being parts of lots Nos. 2 & 3 in Block No. 27, together with all the rights and appurtenances thereunto belonging or in anywise appertaining. The above described property is the same as that now occupied by the "Franco American Restaurant" Hotel; also the furniture in said Hotel, to wit: All the Tables, table cloths, Towels, Wash basins, bowls, and wash stands; All the beds, bedclothes, blankets and bedsteads; All the Dishes, Cooking and Parlor stoves, with their furniture; All the Bureaus and Mirrors; all the carpets, all the chairs, all the tumblers, glasses, bottles, decanters and Liquors, all the wood and in fact every article of property used in said Hotel and which was owned by me previous to my intermarriage with John Guilfoyle my said husband.
    I do hereby declare it as my intention to hold and enjoy all the above described property, real and personal as my own separate property as aforesaid, under the provisions of the Act of the Legislature of the State of Oregon approved June 4th 1859.

    To all whom it may concern: Know ye that I Jeanne Guilfoyle, a married woman and wife of John Guilfoyle of the County of Jackson and State of Oregon, do hereby in addition and supplemental to a declaration made by me and duly acknowledged on the 19th day of October A.D. 1865 and duly recorded by the Recorder of Jackson County in [Oregon] State, in the Register of Married Women's separate property on the 31st of October 1865, make known and declare my intention to hold in my own right separate and apart from my said Husband, and for my separate use and benefit and by his consent, the following described real and personal property, all being in the county & State aforesaid, to wit: Commencing 30 feet from the North West corner of Block Number (27) twenty seven, running thence southerly with the line of Oregon Street, twenty five feet, thence at right Angles in an easterly direction, seventy six feet (76) thence at right angles in a northerly direction, twenty five feet, thence at right angles in a westerly direction seventy six feet, to the place of beginning, All being in Block No. 27 in the Town of Jacksonville. Also the following described personal property, to wit: One sorrel Horse, about three years old, being the same that I obtained from James Simpson. Also, one one horse or single buggy, made by Fred. Covelle and ironed by D. C. Miller in said Town, County and State; Also, the Harness belonging to said Harness [sic] and Buggy.
    I do hereby declare with the consent of my said Husband, it as my determination and intention to hold and enjoy all the above described property real and personal as my own separate property as aforesaid under the provisions of the act of the Legislature of the State of Oregon approved June 4th 1859.

Declaration of Martha Kilgore, a married woman
    I Martha Kilgore, wife of Felix Kilgore, a resident of Jackson County Oregon, do hereby make this my declaration of my intention to hold the following described personal property as my own individually, separate, and apart from the property of my said Husband Felix Kilgore, viz:
    (4) Four cows and calves (3) three of said cows are branded with "S" on the left hip, and marked with an under bit in each ear, and are marked with a crop and slit in the right and under bit and slit in the left ear.
    One two year old marked with a crop and slit in the right and under bit and slit in the left ear and branded thus E E E on the right side.
    (2) two two year old heifers marked with two under bits on the right and one in the left ear and branded thus-- E on the right Jaw (one of the above branded thus-- ┼ on the right hip).
    (3) three year [old] hogs (20 Two heifers and (1) one steer marked with two under bits in the right, and one in the left ear. The above described heifers are branded thus-- E on the right jaw and one of them with a thus on the right hip. The steer above mentioned is branded H on the right hip.
    (2) Two mares and three colts, both of said mares are branded thus "S" on the left shoulder, and one of them with an additional--thus I I I the precise location of which is not recollected.
    All of the above are part of certain personal property acquired by the gift of my father since my marriage with the Kilgore [sic], and by him sold, and repurchased by me with my own funds.
    Also, (1) one cow branded with an E thus "E" on the right jaw and thus E E on the left hip. The above cow was purchased with my own funds (1) Lot of kitchen and Household furniture consisting of One (1) cooking stove with utensils, dishes, bed and bedding and every description of Household and kitchen furniture now in my possession.
    The same being acquired partly by gift, prior to my marriage, from my Father and the rest being acquired by purchase from my own funds. Also, (1) Lot of hogs consisting of (16) sixteen head (12) twelve of which are marked with (2) two under bits in the right and one in the left ear; and (3) three of which are marked with a crop and slit in the right and under bit and slit in the left and the other with an under bit in each ear.
    All of the above hogs were acquired by gift from my Father since my marriage. I do further declare it to be my purpose to brand all of the above cattle & horses thus ┼ or at least so many of the same as are not already thus branded.

Declaration of Mary Fisher
    Know all men by these presents that I Mary Fisher the wife of Daniel F. Fisher and a resident of Jackson County State of Oregon, do hereby declare that I am the owner in my own right of the following described personal property and that I intend to hold the same as my separate property, independent of my said husband or any other person to wit: Nine head of horses and the increase of the same, described as follows: Two work animals--one a sorrel horse and the other a sorrel mare. One brown mare and one bay mare. Two Roan Mares--one of them known as "old gin" and three yearling colts--all being now on the farm owned and occupied by me in said County--also twenty four head of cattle and the increase of the same described as follows. Twelve milch cows--six two years old and six yearlings--all marked with a crop and split in the right ear and a split in the left ear and branded with a P--also a wagon and set of harness and all the farming implements on my said farm at this date. Also all household furniture thereon. All of said property being on or in the vicinity of my said farm in said county of Jackson and having been my property before my marriage with my said husband.

Declaration of Caroline Sexton
    I Caroline Sexton of the County of Jackson, Oregon, do hereby declare my intention of holding the following personal property and pecuniary rights separate & apart from my husband David Sexton, in my own right.
    That said property was acquired by purchase with my own money, acquired before my marriage with my said husband.
    That is to say (35) Thirty five head of horses and cattle all except the colts of last year (1869) branded on the left hip with a circle five inches in diameter with a heart in the center thus [illustration]--
    About (24) Twenty four head of cattle and (5) five head of calves, branded as above and marked with a crop off the right ear and a split in the left--and dewlapped; also
    About (50) Fifty head of hogs, more or less marked with a crop off the right ear and a split in the left.
    One heavy two horse wagon and one buggy and a number of notes, bonds and mortgages and other choses of action, held in my own name.

Declaration of Elizabeth Prater
    Know all men by these presents that I Elizabeth Prater, the wife of Alfred Prater and a resident of Jackson County, State of Oregon, do hereby declare that I am the owner in my own right of the following described personal property, and that I intend to hold the same as my separate property, independent of my said Husband or any other person to wit:
    The undivided one half of the following enumerated machines, implements and stock, being on and belonging to the farm known as the Drake Place on Applegate Creek in said County and being the same property granted and conveyed to me by a bill of sale from M. H. Drake dated the 2nd day of March 1870 to wit:
    One threshing machine, Four Work Mules and the large wagon and the harness belonging thereto. One old Two horse wagon and harness. One light Spring Wagon and the Harness. Three American Work Horses Two of them Sorrels and one a bay. Two bay mares and four colts and the increase of the same.
    About thirty head of loose cattle being the same that were on and belonging to said place at the time said bill of sale was made and the increase thereof. All the hogs on the said place and the increase of the same.
    Also the farming Implements on said place. The undivided half of said property belonging to M. H. Drake and all being now in Jackson County Oregon.

    I Elizabeth Maury a resident of said county do hereby declare that it is my intention "bona fide" hold the following described property right and credits separate and apart from the property rights and credits of my Husband R. F. Maury, to wit; All the real and personal property debts rights and credits of every description whatever which was or may descend to me or in any manner belong to me as heir legatee or distributee of my Father Aaron Chambers' Estate. -- My Father departed this life in Jackson County Oregon on the day 13th September 1869.
    I further declare that it is my intention to hold said property and all pecuniary rights as my separate property, and also all its increase and profits separate and apart from the property of my said Husband for my own use and benefit.

    Know all men by these presents; That I, Martha Ann Collins, wife of James W. Declaration of Mary E. Horn, to hold separate property
    I, Mary Elizabeth Horn Wife of Louis Horn of the County of Jackson Oregon, make oath that in the year 1867, I received a draft for $1093.33 being my distributive share of the property of my deceased Aunt Theresa Hammer, late of Canton Solothurn Switzerland, and that on the seventh day of February 1868 Seven Hundred Dollars being the entire price of [omission?] said sum was applied in the purchase of the following described real estate, lying in the County of Jackson Oregon, that is to say commencing at a point forty nine (49) feet westwardly from the S.W. corner of Block No. 3 in the Town of Jacksonville on the north line of California or B Street which point is on the E. line of a certain lot of land conveyed by C. C. Beekman to Louis Horne [sic], by Deed bearing date Nov. 1st 1860, running from said point Eastwardly on the line of said California or B Street to the W. line of the lot of Land Owned by P. J. Ryan, Thirty five (35) feet more or less thence Northwardly along the West line of said P. J. Ryan's lot Two Hundred (200) feet, to the South line of "C" Street thence along said South line of C Street westwardly to the said East line of the said lot, conveyed by said C. C. Beekman to Louis Horne on Nov. 1st  1860 Thirty Five (35) feet more or less; thence Southwardly along the said East line last mentioned Two Hundred (200) feet to the place of beginning, being in said Block (No. 3) three, also the privilege of using the wall on the West side of the brick building Erected by P. J. Ryan on his said lot above mentioned and adjoining the lot above described, for the purpose of attaching a building to said wall and the privilege of inserting joists and other necessary timbers in said wall to the depth of seven inches, in accordance with the stipulations mentioned in a certain deed of conveyance from said C. C. Beekman to said P. J. Ryan dated 16 June 1860.
    I do further state that although said lot was conveyed by C. C. Beekman to my husband L. Horne it was purchased wholly with my money obtained as my distributive share as aforesaid and that I hereby declare my intention to hold the same separate and apart from the debts and liabilities of my said husband.

    I, Almira Whetstone wife of David Whetstone of Jackson County and State of Oregon, do by these presents declare my intention to hold as my separate property free from the control or liability of my said Husband David Whetstone as follows to wit:

And I claim the right to hold said property in my own right in pursuance of an Act of the Legislative Assembly of Oregon, approved June 4th 1859.

Declaration to hold Personal Property of Mrs. Maggie P. Drumhill
    Know all men by these Presents, that I, Maggie P. Drumhill, of Jackson County, State of Oregon, do hereby declare the following described personal property situated in said County and State, and described as follows, to wit--
    One (1) dark Roan Cow, about 6 years old, part of right
[ear] cut off and branded "B" on the left hip and One (1) dark roan cow (progeny of above described cow) about five (5) months old, with part of right ear cut off; three dozen chickens, 20 tiers of stove wood, four tons of hay and one ton of corn fodder, now in barn on premises, and the Household furniture and personal Property in and upon the premises in Medford, Jackson County, Oregon, and where I now reside, to be my own personal, private and separate and individual personal property, That the said personal property was purchased with money which I possessed at the time of my Marriage or which I acquired since my marriage, by personal labor, and from other than my husband, W. J. Drumhill, and I further declare that my husband has no claim or interest whatsoever in the said personal property, or any part thereof.
